Assumption of Risk and Release

By registering for the Retreat, submitting payment, or electronically accepting these Terms, the participant (“Participant,” “you,” or “your”) agrees to the following terms.

1. Retreat Registration

Registration is not confirmed until Retresana has received the required reservation deposit and accepted your registration.

Retresana reserves the right to decline a registration where reasonably necessary because of accommodation limitations, safety considerations, program requirements, or other legitimate operational reasons, subject to applicable law.

Participation is limited and accommodations are subject to availability.

2. Retreat Price and Inclusions

Shared accommodation is $4,495 per person. Private accommodation is $5,995 per person and is subject to availability.

The Retreat package includes only those accommodations, meals, transportation, programming, activities, and services specifically identified as included on the applicable Retresana registration page or written booking confirmation.

Unless expressly stated otherwise, airfare, passports, visas, travel insurance, optional excursions, spa or wellness treatments, alcoholic beverages, medical care, personal transportation, additional lodging, incidental expenses, and personal purchases are not included.

3. Payment Schedule

A $1,250 non-refundable reservation deposit is due at registration.

Shared accommodation: $1,500 due November 15, 2026; $1,745 due January 5, 2027.

Private accommodation: $2,000 due November 15, 2026; $2,745 due January 5, 2027.

Failure to make a scheduled payment may result in cancellation of your reservation after reasonable notice and an opportunity to cure the missed payment. Amounts previously paid remain subject to the cancellation policy below.

4. Participant Cancellation and Refund Policy

All cancellations must be submitted to Retresana in writing.

The $1,250 reservation deposit is non-refundable.

For cancellations through November 30, 2026, payments received beyond the $1,250 reservation deposit will be refunded.

For cancellations from December 1 through December 31, 2026, 50% of payments received beyond the reservation deposit will be refunded.

For cancellations on or after January 1, 2027, all payments are non-refundable.

Refunds, when due under these Terms, will be returned using the original payment method when reasonably possible.

Failure to attend, late arrival, early departure, missed flights, illness, personal emergencies, or voluntary nonparticipation do not entitle the Participant to a refund except where required by applicable law.

5. Reservation Transfers

If you cannot attend, you may request to transfer your reservation to another eligible person through January 15, 2027.

Transfers require Retresana’s written approval and are subject to accommodation availability, room configuration, completion of all required participant forms and agreements, and payment of any outstanding balance.

Retresana may refuse a proposed transfer where reasonably necessary because of accommodation, safety, program, or operational requirements.

6. Travel Insurance

Retresana strongly recommends comprehensive travel insurance covering, as appropriate, trip cancellation, interruption, delays, medical emergencies, emergency evacuation, baggage loss, and other travel-related risks.

Participants are responsible for understanding the terms, exclusions, and coverage limits of any policy they purchase.

7. Travel Documents and Transportation

Participants are responsible for obtaining and maintaining all passports, visas, entry documentation, and other travel documents required for travel to and from Costa Rica.

Participants are responsible for arranging travel so that they arrive within any designated group transportation windows communicated by Retresana.

Transportation outside designated arrival or departure windows may require separate arrangements and additional expense. Participants must provide requested flight or travel itinerary information by any deadline communicated by Retresana.

8. Health and Wellness Disclaimer

The Retreat is intended for general educational, wellness, and lifestyle purposes. Retresana’s programming is not a substitute for individualized medical diagnosis, treatment, psychotherapy, emergency care, or other professional healthcare services.

Information provided during the Retreat should not be interpreted as individualized medical advice merely because a presenter or facilitator holds a healthcare credential.

Participants remain responsible for their own healthcare decisions and should consult an appropriate healthcare professional regarding medical conditions, medications, dietary restrictions, physical limitations, or concerns about participation.

Participation in the Retreat does not by itself establish a physician-patient or other professional healthcare relationship. Any such relationship must be separately and expressly established by the applicable licensed provider.

9. Participant Health, Dietary, and Accessibility Disclosures

Participants are responsible for informing Retresana, through the appropriate process, of allergies, dietary restrictions, accessibility requirements, physical limitations, or other information reasonably necessary for safe participation and accommodation.

Retresana will make reasonable efforts to accommodate disclosed dietary needs and limitations but cannot guarantee an allergen-free environment or eliminate all risks of cross-contact.

Participants are responsible for bringing and properly managing their own medications and medical devices. Participants should provide only information reasonably necessary for retreat operations and should not submit complete medical records unless specifically requested through an appropriate process.

10. Voluntary Participation and Assumption of Risk

Retreat activities may include yoga, stretching, mobility and movement activities, meditation, breathwork, swimming, walking or hiking on tropical or uneven terrain, wellness services, transportation, beach and nature activities, excursions, and other physical or recreational activities.

Participation in individual activities is voluntary unless participation is reasonably necessary for safety or logistics.

You understand that travel and these activities involve inherent and other risks, which may include slips, falls, drowning, physical injury, illness, adverse weather, wildlife encounters, transportation incidents, equipment failure, environmental hazards, and actions or omissions of third-party providers.

By participating, you knowingly assume the ordinary and inherent risks associated with the activities you voluntarily choose to undertake, to the extent permitted by applicable law.

11. Participant Responsibility and Conduct

Participants agree to follow reasonable safety and operational instructions from Retresana, Mandala Ojochal, facilitators, and activity providers.

Participants should discontinue an activity and inform the appropriate facilitator if they believe participation may be unsafe for them.

Participants must behave in a manner reasonably consistent with the safety, dignity, and enjoyment of other participants, staff, and local communities. Dangerous, threatening, abusive, harassing, unlawful, or materially disruptive conduct is prohibited.

Retresana may remove a Participant from an activity or, in serious circumstances, from the Retreat for such conduct. A Participant removed for conduct reasons is responsible for resulting transportation or accommodation expenses and is not automatically entitled to a refund.

Participants are responsible for their personal property and for costs arising from damage they intentionally cause or cause through conduct for which they are legally responsible.

12. Third-Party Providers

Certain transportation, excursions, wellness services, accommodations, and other activities may be provided by independent third parties rather than Retresana.

Those providers may maintain their own terms, waivers, eligibility requirements, safety procedures, and cancellation policies. Participants agree to comply with reasonable requirements imposed by such providers as a condition of participating in their services.

Retresana does not control every act or omission of independent third-party providers.

13. Release and Limitation of Liability

To the fullest extent permitted by applicable law, Participant releases Retresana, its owners, officers, employees, retreat leaders, agents, and representatives from claims arising from the ordinary and inherent risks voluntarily assumed under these Terms.

Nothing in these Terms is intended to waive or limit liability that cannot lawfully be waived or limited, including liability arising from conduct for which a waiver is prohibited by applicable law.

14. Emergency Medical Care

If a Participant becomes ill or injured and is unable to make or communicate an informed decision, Participant authorizes Retresana and its representatives, where reasonably necessary, to contact emergency services and assist in arranging appropriate medical care.

Participant remains financially responsible for medical treatment, emergency transportation, evacuation, and related expenses to the extent not otherwise covered.

15. Program and Itinerary Changes

Retresana may reasonably modify schedules, facilitators, activities, meals, transportation arrangements, excursions, or other program details when necessary because of weather, safety, availability, operational circumstances, or conditions beyond Retresana’s reasonable control.

Retresana will make reasonable efforts to provide a substantially comparable overall Retreat experience where circumstances require a change.

Minor itinerary or program changes do not automatically entitle a Participant to a refund.

16. Retreat Cancellation and Force Majeure

If Retresana cancels the Retreat for reasons within Retresana’s reasonable control, Retresana will refund Retreat payments received from Participant for services not provided, subject to applicable law.

For events beyond Retresana’s reasonable control — including severe weather, natural disasters, epidemics or pandemics, government restrictions, airport closures, civil unrest, labor disruptions, utility failures, or similar events — Retresana may, where reasonably appropriate and legally permitted, reschedule the Retreat, provide transferable credit, refund amounts recoverable from suppliers, or offer another reasonable remedy based on the circumstances.

Retresana is not responsible for unrecoverable airfare, independent lodging, or other travel expenses purchased separately by the Participant.

17. Resort Rules

Participants must comply with Mandala Ojochal’s applicable guest, safety, and facility rules and with reasonable instructions communicated by the resort.

Mandala Ojochal currently observes quiet hours from 9:00 p.m. to 8:00 a.m. Retresana will communicate additional material resort requirements before arrival.

18. Photography and Media

Promotional photography and video consent is handled separately from acceptance of these Terms.

A Participant’s decision not to consent to identifiable promotional photography or video will not, by itself, affect eligibility to attend the Retreat. Retresana will make reasonable efforts to respect each Participant’s recorded media preference.

19. Privacy and Personal Information

Retresana collects and processes personal information for purposes including retreat registration, payments, accommodations, meals, transportation, communications, safety, and administration.

Dietary, allergy, accessibility, and other health-related information supplied for retreat operations will be handled as sensitive information and used only as described in Retresana’s Privacy Policy and as permitted by applicable law.

The Retresana Privacy Policy, available through the registration process and website, explains Retresana’s privacy practices in greater detail.

20. Governing Law and Dispute Resolution

This Agreement is governed by the laws of the State of Florida. Any dispute will be resolved exclusively in the state or federal courts located in Seminole County, Florida.

21. Entire Agreement; Electronic Acceptance; Severability

These Terms, together with the Participant’s registration confirmation and any documents expressly incorporated into them, constitute the agreement between Retresana and Participant regarding participation in the Retreat.

Any amendment must be made in writing by Retresana.

Electronic acceptance, electronic signatures, and electronic payment may be used to evidence Participant’s agreement to these Terms to the extent permitted by applicable law.

If any provision is determined to be unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

Participant Acknowledgment

By checking the required acceptance box during online registration, electronically signing, or otherwise expressly accepting these Terms, Participant acknowledges that Participant has read and understands this agreement, including the payment and cancellation terms, assumption of risk provisions, health and wellness disclaimer, and release language.
